Agreement to Terms

By accessing or using the website and services of MyAlly Care, LLC (“MyAlly,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

Your use of the platform constitutes your electronic acceptance of these Terms. This electronic agreement has the same legal effect as a physical signature.

Eligibility

You must be at least 18 years of age to use our platform or services. By using our platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are under 18, you may not use our platform or services. If you are using our platform on behalf of another individual, you represent that you are authorized to accept these Terms on their behalf.

Services Description

MyAlly provides a platform that connects individuals seeking mental health support with licensed therapists and psychiatric providers. Our website provides information about our services, allows you to find and match with providers, and provides a secure portal for clients to access their accounts.

Important: The information on this website is for general informational purposes only and does not constitute medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical or mental health condition.

MyAlly is a technology platform, not a healthcare provider. Healthcare providers listed on our platform are independent licensed professionals, not employees or agents of MyAlly. No provider-patient relationship is established between you and MyAlly. Any provider-patient relationship exists solely between you and the independent healthcare provider you are matched with through our platform.

You are responsible for choosing your own healthcare provider, including determining whether a provider is suitable for your needs based on specialty, experience, qualifications, and licensure. MyAlly does not endorse, recommend, or guarantee any particular provider, and is not responsible for the quality, safety, or outcomes of any services provided by healthcare providers accessed through our platform. MyAlly is not liable for any act, omission, malpractice, or negligence of any healthcare provider.

SMS/Text Message Terms

By providing your mobile phone number and opting in to receive text messages from MyAlly, you agree to the following:

  • You consent to receive automated text messages related to appointment reminders, account notifications, and service updates.
  • Message frequency varies based on your appointments and account activity.
  • Message and data rates may apply. Check with your mobile carrier for details.
  • You can opt out at any time by replying STOP to any message.
  • For help, reply HELP or email us at support@myally.care.
  • Consent to receive text messages is not a condition of service.

Carriers supported include major US carriers. Carrier and handset limitations may affect service availability.

User Accounts

If you create an account on our platform, you are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

Account Termination

You may close your account at any time by contacting us. We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms of Service, engaged in fraudulent or illegal activity, or if continued access poses a risk to the security of our platform or other users.

Upon termination, your right to use the platform ceases immediately. Data retention and deletion following account closure are governed by our Privacy Policy.

Acceptable Use

You agree not to use our website or services to:

  • Violate any applicable laws or regulations
  • Impersonate any person or entity
  • Transmit harmful code, spam, or malicious content
  • Interfere with the operation of our services
  • Access accounts or data belonging to others without authorization

Third-Party Services

Our platform integrates with third-party services, including Google Calendar, to provide scheduling and appointment management features. Your use of these integrations is subject to the respective third-party terms of service and privacy policies in addition to these Terms. Please refer to our Privacy Policy for details on how we access, use, store, and delete data from third-party services including Google APIs.

MyAlly is not responsible for the practices or content of third-party services. Links to external websites or resources are provided for convenience and do not imply endorsement.

Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of MyAlly Care and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

Disclaimer of Warranties

Our website and services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, timely, error-free, or secure, or that any defects will be corrected.

We make no representations or warranties regarding the qualifications, expertise, quality of work, or availability of any healthcare provider accessible through our platform. We do not guarantee that you will find a suitable provider or that any provider will be available at any particular time.

Limitation of Liability

To the fullest extent permitted by law, MyAlly Care shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, including but not limited to damages for loss of data, loss of profits, business interruption, or any injury or loss resulting from the conduct of any healthcare provider accessed through our platform.

In no event shall MyAlly's total cumulative liability to you for all claims arising from or related to your use of the platform exceed one hundred U.S. dollars ($100). This limitation applies regardless of the form of action, whether in contract, tort, or otherwise. This limitation does not apply to any liability that cannot be excluded or limited by applicable law.

Release of Liability for Provider Conduct

You acknowledge that MyAlly has no control over and no duty to take any action regarding the conduct of any healthcare provider on our platform. You hereby release MyAlly and its officers, directors, employees, agents, and successors from any and all claims, demands, damages, losses, and expenses of any kind, whether known or unknown, arising from or related to the actions or omissions of any healthcare provider you interact with through our platform.

Indemnification

You agree to indemnify, defend, and hold harmless MyAlly Care and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the platform or services; (b) your violation of these Terms of Service; (c) your violation of any rights of another person or entity; or (d) any actions taken by anyone using your account credentials. This indemnification obligation does not apply to liability arising from MyAlly's own gross negligence or intentional misconduct.

Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

Emergency Services

Our website and text messaging services are not intended for emergency use. If you are experiencing a mental health emergency, please:

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of such courts.

Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

Assignment

We may assign or transfer these Terms, and any rights and obligations hereunder, at any time without notice, including in connection with any merger, acquisition, or sale of assets. You may not assign or transfer these Terms or any rights hereunder without our prior written consent, and any attempted assignment without such consent shall be void.

Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and MyAlly regarding your use of our platform and services, and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page. Your continued use of our services after any changes constitutes acceptance of the new terms.
